Question:
Salaam-alaykum,
Dear beloved Shaykhs,
I have a question regarding inheritance. A man was married to a woman and has four children. He divorced her and married a second wife and has two children. He gave each of the children a house with different values (some are more expensive that the others). He also has a company and other inheritance (money, gold). How should he divide the inheritance properly (including the houses) according to shariat law?
Jazakallahu khayran.
Answer:
Wa `alaykum salam,
His divorced wife keeps all gifts she received from him and may be entitled to much more in alimony, child support, housing, etc. as determined by the courts. We want to quote here this verse: “And their wives’ rights are equal to their obligations in a just manner.” (2:228)
