Salamu alaykum ya sheikh,
I am from Europe in 2007 i made hidjrah (relocate) to UAE all alone and in my hidjrah I married with (x). In the beginning everything was fine. We went together to Umrah and everything alhamdulilah. After a while he told me he wants to relocate to Europe (he is Syrian citizen) but in the beginning of our marriage he told me we are staying in UAE for our deen and Islam. I am now back alone in Europe and now I visit him only one time a year because I can not make any visa or iqama. He also don’t want me to return back to UAE because if crisis and no job. What should i do ? What dua ?
Answer:
Alaykum Salam,
If there is no cohabitation for 4 months or more, the marriage is dissolved unless there is mutual agreement in case of emergency such as hospital or jail confinement. Otherwise when the fundamental condition of marriage disappears then there is no marriage anymore. If he intends for this marriage to continue then the living arrangement or visits have to be more frequent. Of course all this is assuming he also gives you living expenses, without which the same result applies. You may speak with him and makes things clear, because for sure no Syrian wife would put up with this.
