Question:
Salaam Alaykum Maulana Shaykh Hisham,
If a women is divorced from her husband but they want to marry again Islamic scholars say if the women wants to remarry her first husband she has to marry and have sexual intercourse and then she can divorce her second husband & then only can she marry her first husband.
Is it allowed to intentionally marry someone bearing in mind that she is doing this to get a divorce and to return and marry her first husband? I’ve heard of a case where after a girl was divorced, her family explained the reason for her second marriage being only so she can divorce and then be allowed to marry her first husband. The second husband agreed to help the girl & her family as he was aware of the situation. He wasn’t cheated but is this allowed? Could you explain this in the light of Holy Quran & hadees?

Answer:
`Alaykum Salam
If a single or two divorces took place she can remarry him without
problem. If three divorces took place then she cannot remarry him until
she first gets married, consummates the marriage, and gets divorced by
another man.
