Question:
If a woman is not living with her husband for more than one year as separation due to differences, and later the man divorces her, is she supposed to observe iddat?
In this scenario can someone sent marriage proposal?
Answer:
Yes, she is supposed to observe `idda, because:
(i) during the year of separation her status remained that of being his wife and
(ii) `idda can only count after a divorce is pronounced and not before.
In this scenario no one may send any marriage proposal because she is still someone else’s wife until the end of the `idda. And Allah knows best.
