Divorce – Talaq

Question:

Salam Aleykum WRWB,

I was wondering if someone with good knowledge of Islamic view and understanding of Talaq can help with my confusion. We are Sunni.

My husband and I were arguing one day and we were both angry and he said, ‘Should I give you talaq?’…. anyway, the situation was diffused that day.

A few months later we were both again having a row, and I was quite upset and asked him to give me Talaq. He was sitting and said 2 times ‘I give you talaq’… but he couldn’t say third time. Anyway. I’m wondering if the first time his question is to be taken as first talaq?

Please give your opinion on the state of our current relationship. Thank you.

Answer:

wa `alaykum salam,

The question ‘Should I give you talaq?’ does not count as talaq. The statement ‘I give you talaq’ counts as talaq. If repeated a second time, it counts as two talaqs. The status of such a couple is divorce. If they reconcile they do not need to renew their contract. However, if a third divorce takes place, she cannot re-marry him unless she marries, consummates marriage, and divorces another man first.
