Is everything haram until proven halal?

Question:

Assalamu Alaykum Shaykh,
I pray that you are well and that you and your family are in the best of health and Iman – Ameen. May Allah Azawajal bless our master Mawlana Shaykh Nazim Al Haqqani Al Rabbani Q.S – Ameen. Shaykh quick question: A brother from Salafi beliefs said:

Everything is haram in the deen until you prove it Halal.

Is it not the other way around and any quotes of evidence that I can give him? JazakAllah Khair. MashaAllah your answers online are helping me deal with opposing questions and making some neo-Salafis who are young and being misguided think about their filthy beliefs. Madad Ya Shaykh Nazim, with your Madad the Haq is put forth to all those who deny and for those who believe they are refreshed. We love you Sayidi Wa Murshidi Sultan Ul Awlia.

Assalamu Alaykum

Answer:

wa `alaykum salam,
Amin. May Allah bless you and yours also.

The preponderant position according to the vast majority of the scholars (al-rajih `inda al-jumhur) is that in our Religion “the default in things is permissibility” (al-aslu fil-ashya’ al-ibaha) until proven haram. For example, foods are all considered halal until proven haram, and likewise contracts are all considered valid until proven otherwise. They applied the default ruling of haram to certain major exceptions such as taking lives (dima‘), sexual intercourse (abda`), using properties (amwal), and defamation (a`rad).
