Nazar- “Making vow” in Wrong Intention

Question:

Assalammualaikum Sheikh Hisyam,
My name is [private] from Malaysia. One of my friend (Naqshabandi murid) ask me to write this question. My friend just recently moved to a new bungalow lot and his wife has make a vow-“Nazar” not to sleep with him until the land title changed to her daughter’s name. Is this ‘Nazar” is valid and what is the syariah law saying about this? Kindly pray for him to take away this problem. Make doa also for me to success in spiritual path and daily practise.
Wassalam.

Answer:

wa `alaykum salam,

Nadhar (Arabic: نذر‎) is a vow or promise made to perform certain actions that is recommended by Shari`ah. They must be lawful acts of worship. Since the person who made the vow, based on the description given below, is the lawful wife, she cannot make such a vow based on such a premise, hence the vow is invalid. You may read this Vows and Oaths for general understanding.

Advise him to recite Hasbunallahu wa Ni`mal Wakeel 100 times, Ya Muqallibal Quluubi wal Absaar, Thabbit Quluubanaa `alaa Deenika wa Ta`atik 100 times daily. Insha-Allah, Mawlana Shaykh Hisham will be praying for you.
